Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your use of the PackPT mobile application and website (the "App").

By accessing or using PackPT, you agree to be bound by these Terms. If you do not agree, you must not use the App.

PackPT is operated by Pack PT, a company registered in England and Wales with company number 15538013 and registered office at C/O T P Jones & Co, 23, Victoria Avenue, Harrogate, North Yorkshire, United Kingdom, HG1 5RD.

2. Changes to These Terms

We may update these Terms from time to time.

Where changes are material, we will notify you via:

  • In-app notification, or
  • Email (if provided)

Your continued use of the App constitutes acceptance of the updated Terms.

3. Eligibility

You must:

  • Be at least 18 years old

You confirm that:

  • All information you provide is accurate
  • You will use the App only for personal, non-commercial use

4. Health and Fitness Disclaimer

PackPT provides fitness planning, tracking, and habit-support tools. It does not provide medical advice.

You acknowledge that:

  • The App is not a substitute for professional medical advice, diagnosis, or treatment
  • You should consult a qualified healthcare professional before starting any exercise programme
  • You use the App at your own risk

5. Assumption of Risk

By using PackPT, you acknowledge and agree that:

  • Physical exercise involves inherent risks, including injury or illness
  • You voluntarily participate in all activities suggested by the App
  • You are responsible for selecting appropriate weights and intensity, using proper technique, and monitoring your own physical condition

PackPT is not liable for injuries or damages resulting from your use of the App.

6. User Accounts

To access certain features, you must create an account.

You agree to:

  • Keep your login credentials secure
  • Not share your account with others
  • Notify us immediately of any unauthorised access

You are responsible for all activity under your account.

7. Acceptable Use

You agree not to:

  • Use the App for unlawful purposes
  • Harass, abuse, or harm other users
  • Upload malicious code or attempt to disrupt the App
  • Reverse engineer, copy, or resell any part of the App
  • Use the App to provide commercial coaching services without permission

We reserve the right to suspend or terminate your account if you violate these Terms.

8. Content and Intellectual Property

All content within PackPT, including workout plans, training structures, data models, branding, and design, is owned by or licensed to PackPT.

You are granted a limited, non-exclusive, non-transferable licence for personal use only.

You may not:

  • Copy, distribute, or modify content
  • Use content for commercial purposes

9. Third-Party Services

The App may integrate with third-party services (e.g. Apple Health, Google Fit).

We are not responsible for:

  • The accuracy of third-party data
  • The operation of third-party services

Your use of such services is subject to their own terms.

10. Subscriptions, Trials and Payments

Payment Processing

All subscription payments are processed through the Apple App Store or Google Play Store (collectively, the "App Stores"). PackPT does not process payments directly. By purchasing a subscription, you agree to the applicable App Store's terms and conditions in addition to these Terms. Your payment will be charged to your App Store account at confirmation of purchase.

Free Trial

We may offer a free trial (e.g. 14 days). After the trial, you may be required to subscribe to continue using certain features.

Subscription Plans

  • Pricing and features will be displayed in the App
  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the selected plan
  • We will give you at least 30 days' notice before any price increase takes effect. Existing subscribers will be notified via email or in-app notification before changes apply to their plan

Cancellation

You can cancel at any time via your App Store account settings. Subscriptions may be managed and auto-renewal may be turned off by going to your account settings on the Apple App Store or Google Play Store after purchase.

Access continues until the end of the current billing period.

Refunds

Payments are non-refundable unless required by applicable consumer protection law. As all payments are processed by the Apple App Store or Google Play Store, any refund requests must be directed to the relevant App Store. PackPT does not have the ability to process refunds on behalf of the App Stores.

11. Early Access / Beta Use

If you are using PackPT during an early access or beta phase:

  • Features may change or be removed without notice
  • The App may contain bugs or errors
  • Data may not always be preserved

You agree to use the App with this understanding.

12. Service Availability

We do not guarantee that:

  • The App will be uninterrupted
  • The App will be error-free
  • Data will always be available or accurate

We may modify or discontinue features at any time.

13. Limitation of Liability

To the fullest extent permitted by law, PackPT shall not be liable for:

  • Any indirect or consequential loss
  • Loss of data, profits, or fitness outcomes
  • Injuries or health issues arising from use of the App

Our total liability shall not exceed the amount you have paid to us in the last 12 months.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

14. Indemnification

You agree to indemnify and hold PackPT harmless from any claims arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your infringement of third-party rights

15. Termination

We may suspend or terminate your account if:

  • You breach these Terms
  • We suspect misuse

You may stop using the App at any time.

Upon termination, your right to use the App ceases immediately. We may, at our discretion, delete your account data, unless we are required by law to retain it.

16. Privacy

Your use of the App is also governed by our Privacy Policy.

The Privacy Policy explains how we collect, use, store, and protect your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

By using the App, you acknowledge that you have read and understood the Privacy Policy.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you may also have the right to bring proceedings in the courts of your country of residence if it is within the United Kingdom, and nothing in these Terms affects your statutory rights as a consumer.

We encourage you to contact us first at hello@packpt.app to resolve any dispute informally before initiating formal proceedings.

18. Entire Agreement

These Terms, together with the Privacy Policy and any other documents expressly referred to herein, constitute the entire agreement between you and PackPT in relation to your use of the App.

They supersede all previous agreements, understandings, and arrangements between you and PackPT, whether written or oral.
